A political advisor will propose a ban on group sex between men at the country’s annual legislative sessions which begin tomorrow (4 March).

Professor Sun Jianfang from the Institute of Dermatology at Peking Union Medical College said the measure would help prevent the spread of AIDS.

The member of the Chinese People’s Political Consultative Conference said current laws on prostitution and group sex were limited to heterosexuals and should be amended to explicitly criminalize gay sex, the state-run Xinhua Daily reported.

According to statistics, the proportion of HIV transmission between men who have sex with men rose from 2.5% in 2006 to 25.1% in the first half of last year.

Gay sex is now the most common mode of transmission, especially in cities.

Section 301 of the Penal Code criminalizes consensual group sex between three or more people, regardless of gender.

China’s leading sexologist, Li Yinhe, said there were no victims when three or more consenting adults had sex and and therefore they should not be punished by criminal law.

‘The crime of group sex is an outdated law, an erroneous law. Its abolishment would not harm social customs, nor corrupt social values,’ she wrote on Weibo.
